Kaspersky 2010 Pure trial version; is it one of those scams where they scan, tell you you have so many malware?

Kaspersky is completely legitimate. It will say that because the company do not go updating the virus definitions for everyone that download's the program. After the trial period has finished, it will not longer operate unless you purchase the license.
